Sunnah vs Bid'ah Divorce
☀️🌙 Sunni vs. Bid'i Divorce — The Right and Wrong Way
The Prophet ﷺ said to Ibn Umar when he divorced during menstruation:
"Order him to take her back."
— [Al-Bukhari and Muslim]
📖 Introduction
📜 Scene: The Regretful Divorce
In the masjid after Fajr...
A man approached the imam with worry on his face:
"Sheikh, I divorced my wife last night during her period. I was angry and didn't think..."
The imam asked: "Did you know the ruling?"
He said: "I knew it was wrong, but I still did it..."
The imam said:
"This is called bid'i divorce — it is sinful, but according to the majority of scholars, it still counts. You must take her back immediately, then wait for the proper time if you still want to divorce."
The man asked: "There's a proper time for divorce?"
The imam said:
"Yes, everything in Islam has an adab — even divorce."

☀️ Sunni (Sunnah) Divorce
Conditions
| Condition | Explanation |
|---|---|
| 1️⃣ During purity (tuhr) | Not during menstruation |
| 2️⃣ Without intercourse in that cycle | Hasn't had relations since she became pure |
| 3️⃣ One divorce only | Not multiple at once |
Why These Conditions?
| Condition | Wisdom |
|---|---|
| 🩸 Not during menses | So 'iddah can be properly calculated |
| 🚫 No recent intimacy | She might be pregnant (changes 'iddah) |
| 1️⃣ Only one | Preserves chance of reconciliation |
The Evidence
When Ibn Umar divorced during menstruation, the Prophet ﷺ ordered him to take her back and wait:
"...until she becomes pure, then menstruates again, then becomes pure again. Then if he wishes, he may keep her, or divorce her before having relations."
— [Al-Bukhari and Muslim]
🌙 Bid'i (Innovated) Divorce

📜 Story: The Prophet ﷺ Corrects Ibn Umar
The Full Story
Abdullah ibn Umar — may Allah be pleased with him — divorced his wife while she was menstruating during the time of the Prophet ﷺ.
Umar ibn al-Khattab asked the Prophet ﷺ about this.
The Prophet ﷺ became angry and said:
"Order him to take her back and keep her until she becomes pure, then menstruates, then becomes pure again. Then after that, if he wants to keep her, he keeps her, and if he wants to divorce her, he divorces her before he touches her. That is the 'iddah which Allah commanded women to be divorced in."
