Child custody

👶 Al-Hadanah — Child Custody

The Prophet ﷺ said to a woman:

"You have more right to him (your child) as long as you do not remarry."

[Abu Dawud]

📖 Introduction

📜 Scene: A Mother's Plea

In the time of the Prophet ﷺ...

A woman came saying:

"O Messenger of Allah, this son of mine — my womb was a vessel for him, my breast nursed him, my lap sheltered him, and now his father has divorced me and wants to take him from me!"

The Prophet ﷺ said:

"You have more right to him as long as you do not remarry."

[Abu Dawud]

🎯 Islam protects children's bonds with their mothers!

📜 Scene: The Father's Rights

After the divorce...

A man asked: "She has custody, but can I see my children?"

The scholar said:

"Custody is hers for nurturing, but you remain their father. You have:

  • The right to see them regularly
  • The duty to provide for them
  • Authority over major decisions

The children need both parents."

💡 Custody is about the child's wellbeing — not about winning!
