Juristic Effort

🔍 Al-Ijtihad — Juristic Effort

The Prophet ﷺ said:

"If a judge makes ijtihad and is correct, he has two rewards. If he makes ijtihad and errs, he has one reward."

[Al-Bukhari and Muslim]

📖 Introduction

📜 Scene: Ali and the Disputed Pregnancy

Kufa, during the caliphate of Ali...

A woman was brought to Ali ibn Abi Talib — may Allah be pleased with him — who gave birth six months after marriage.

Her husband accused her of zina!

Ali ruled:

"The minimum pregnancy is six months!"

They asked: "How did you know?"

Ali answered, combining two verses:

﴿ And his gestation and weaning is thirty months ﴾ + ﴿ And weaning is two years ﴾

30 months - 24 months = 6 months!

🎯 This is ijtihad — exerting effort to derive a ruling from the texts!

📜 Scene: Ibn Abbas and Inheritance

A complex inheritance case was brought to Ibn Abbas — may Allah be pleased with him.

He sat and calculated, then said:

"If I gave each their full share, nothing would remain. So I will distribute proportionally."

This is what became known as 'Awl (proportional reduction in inheritance).

💡 Ijtihad = using evidence + intellect + knowledge!

Imam Ash-Shafi'i — may Allah have mercy on him — said:

"If the hadith is authentic, it is my madhhab."

Imam Abu Hanifa — may Allah have mercy on him — said:

"This is my opinion, and it is the best I could reach. Whoever comes with better, we accept it."

Imam Ahmad — may Allah have mercy on him — said:
